Where the Prop 8 Media missed the point...

When comparing the issues that many religious people care about in the recent Proposition 8 court decision and how the media reported the ruling this week, there is a disconnect.

At the heart of Duncan's arguments were that Judge Walker simply rejected any conclusion about the value of marriage to society. Walker supported his ruling with the untenable sentiment that those who support marriage between a man and woman are simply motivated by hatred toward those who seek same-sex marriage. Duncan also said that same-sex marriage proponents try to paint religious beliefs about traditional marriage as hurtful and harmful. Indeed, Walker accepted opponent's logic that animosity drove voters to approve Proposition 8. Duncan questioned whether such feelings were on voters' minds when they voted to pass the proposition.

In Alice in Wonderland, (a book written by a mathematician) the logic of the Kangaroo trial is written in plain splendor. The King of Hearts, presiding in a trial, is able to direct the outcome he wishes simply by putting his finger on the scale of what is to be considered important or unimportant. While his legal rigor may or may not be good, it is clear to me his judgement is lacking. And in a case where the question is what we consider important or unimportant, it seems the people should be given the final say. He has his opinion (as did millions of other Californians) but legally the ballot box tipped in favor of the millions in favor of expecting gender integration in each state recognized marriage.
