Is the constitution ever unconstitutional?

In our 'judicial' tag, we've wrestled with the possibility that marriage neuterists would get so frustrated with the people and the constitution that they actually throw both out on their proverbial ear.

Do my eyes deceive me? Did that just happen in Texas?

As an a attorney --- No, it cannot be unconsitutional (except by a Federal court) This judge is simply thowing out the law in order to grandstand and help re-establish the conviction that the case for same -sex marriage is unassailable. More P.R campaign than law - yet effective because it reinforces the idea that marriage is a violation of basic consitutional guarantees
